What is it?
Trademark Renewal is the process of renewing a registered trademark before or after its expiry date - extending the registration for another 10-year term. Trademark registration in India is valid for 10 years from the date of filing and can be renewed indefinitely, providing perpetual brand protection.
Renewal timeline
Renewal can be filed up to 6 months before the expiry date (with standard fee) or up to 6 months after expiry (with a surcharge). Renewal is filed in Form TM-R on the IP India portal. After renewal, a new registration certificate reflecting the extended validity period is issued.
Consequences of non-renewal
If the trademark is not renewed within the grace period (6 months after expiry), the trademark is removed from the register. A removed trademark can be restored on application within 1 year of removal - with an additional restoration fee. After 1 year, the mark is permanently removed and protection is lost.
Renewal for multiple classes
If the trademark is registered in multiple classes, renewal must be filed and fees paid for each class separately - or for all classes together in a single application. We manage renewals for multi-class registrations.
