Overview - rti application drafting legal services Registration

What is it?

The Right to Information (RTI) Act, 2005 gives every Indian citizen the right to request information held by public authorities - Central and State government departments, PSUs, courts, regulatory bodies, and even certain NGOs substantially funded by government. Information must be provided within 30 days (48 hours for life/liberty matters).

Scope of the RTI Act

'Information' under the RTI Act includes: records, documents, memos, emails, opinions, advices, press releases, circulars, orders, logbooks, contracts, reports, papers, samples, and any other material held in any form. The RTI covers virtually all information held by public authorities - with limited exemptions.

Exemptions from disclosure

Section 8 of the RTI Act exempts: information affecting national security, cabinet notes, commercial confidence of third parties (trade secrets), fiduciary information, and personal information unrelated to public activity. These exemptions are not absolute - public interest can override them.

First and Second Appeals

If the CPIO (Central Public Information Officer) fails to respond within 30 days or provides unsatisfactory information, a First Appeal lies to the First Appellate Authority within 30 days. A Second Appeal (or complaint) then lies to the Central or State Information Commission.
