It operates alongside criminal remedies under the IPC (Section 498A - cruelty by husband).
Definition of domestic violence
The PWDVA defines domestic violence broadly to include: Physical abuse (assault, causing bodily pain), Sexual abuse (marital rape, forcing sexual acts), Verbal and emotional abuse (insults, threats, humiliation, name-calling), Economic abuse (withholding money, depriving access to financial resources), and Harassment (including dowry demands).
Remedies available
Protection Order: Prohibits the respondent from committing any act of domestic violence, contacting the applicant, or approaching her workplace or the children's school. Residence Order: Restrains the respondent from dispossessing the applicant from the shared household. Monetary Relief: Covers loss of earnings, medical expenses, maintenance, and property damage.
